Anthropic expanded its Claude Startups program on Oct. 6 at its SF Tech Week event, and its Claude account announced the change at 16:49 UTC with 4.7 million views by Oct. 87. Russell Brandom of TechCrunch listed the package: a free year of Claude Team with up to five premium seats, $1,000 in API credits, access to Claude Marketplace, and virtual office hours with the Applied AI team2. Companies founded in the last five years or funded in the last two qualify2. Two hours and 44 minutes later, Rich Stureborg, chief executive of Acrebase, posted the terms1. His post reached 175,000 views in a day, against 4.7 million for the announcement it answered17.
What Anthropic says the program is for
Anthropic's reason, as TechCrunch quoted it: "We created this program because we believe the benefits of AI will reach most people through the companies that build on top of models, rather than through the models alone. That makes partnering closely with founders and developers central to our mission."2 The mission statement puts founders at the center. The documents that govern the offer are what Stureborg read.
Four clauses, checked against the documents
Stureborg's post names four sections. "The terms for this sucks, and you agree to them by just applying," he wrote, then listed them: §2.4, which he said lets Anthropic "develop similar or competitive technology" and reuse "general ideas, know-how and techniques remembered by personnel looking at your data"; §D.4, which "prohibits accessing their services to build competing products or services"; §F.1, which he said "allows them to retain and perform safety reviews, superseding ZDR"; and §6, which "permits changes to the addendum at any time without notice or liability"1. The addendum, effective Oct. 6, holds the first in section 2.4, titled Residuals: "Anthropic may use, for any purpose and without obligation to you, any information, ideas, know-how, and techniques of a general nature retained in the unaided memory of Anthropic personnel who had access to your Confidential Information."3 The same section continues: "You acknowledge that Anthropic serves many customers, may independently develop similar or competitive technology, and may assign the same personnel to other customers, and nothing in this Addendum restricts Anthropic from doing so."3 The section withholds any license under the founder's patents or copyrights and keeps the confidential information itself off limits to disclosure3.
Section D.4 of Anthropic's Commercial Terms of Service, effective June 17, 2025, holds the second. A customer "may not and must not attempt to (a) access the Services to build a competing product or service, including to train competing AI models or resell the Services except as expressly approved by Anthropic"5. Stureborg's reading joins the two: Anthropic may build what matches a member's product, and a member may build what competes with Anthropic's only with Anthropic's express approval.
Addendum section 6 holds clause four: "Anthropic may modify this Addendum, at any time without notice or liability."3 The program terms, last updated May 22, 2025, add that applicants "agree to be bound by the decisions of Anthropic"4. Anthropic may cancel or suspend the program, and its liability is capped at the value of the benefits awarded or $1,000, whichever is less4.
Clause three sits outside all three documents. Section F of the Commercial Terms covers intellectual property, and the phrase "safety review" and the words "zero data retention" are missing from each document345. The clause may sit in a document the post omits, or in an earlier version. Three of four hold as quoted, and the fourth awaits its page.
What the offer is worth, and what the clause covers
Startup Fortune read the same documents on Oct. 7 and priced the package6. A year of Claude Team comes to about $6,000, the $1,000 credit expires after six months, partner offers carry a combined list value of up to $45,000, and office hours come with "no promised amount of support"6. Its view was plain: "Our view is that the offer is too small and the terms too one-sided for a program aimed at the least protected companies in the market."6 The outlet also noted that both documents it read leave Confidential Information undefined6.

Read as a contract, the residuals clause is a standard term in consulting and partnership agreements, and the addendum limits it to what staff retain "in the unaided memory" after office hours3. As a market position, it arrives from a company whose own terms forbid the customer the reverse. The asymmetry is the finding, and both companies in the exchange wrote it: Anthropic in sections 2.4 and D.4, and the founder in the application that accepts them.
What each side needs
Anthropic's case needs the office hours to deliver advice a founder would pay more for elsewhere, and the residuals clause to stay unused against a member. Stureborg's case needs one documented instance of Anthropic shipping a product that a member brought to office hours first. Both cases await a public example, and the program is two days old.
